Milbon USA DA-Link USA 2026 Audience Participation Terms
These Audience Participation Terms (“Terms”) govern your participation as a member of the Audience at DA-Link 2026 (the “Event”), which is organized and administered by Milbon USA, Inc. (“Milbon”). All ticket purchasers and holders, excluding contestants, contestant’s assistants, and contestant’s models, shall be referred to as the "Audience." Attendance at the Event is also subject to Milbon’s Terms of Service, which can be found at https://pro.milbon-usa.com/policies/terms-of-service. In the event of any conflict between these Terms and Milbon’s Terms of Service, these Terms shall supersede and govern.
1. Event Photography and Videography
Audience acknowledges that photography and videography will occur within the Event venue, and they may appear in such media, whether intentionally or incidentally. Milbon, contestants, assistants, models, and other Audience members and their authorized third parties may freely use, reproduce, modify, publish, edit, and distribute these photographs and videos for promotional purposes in advertisements, websites, social media, brochures, and other materials worldwide. Audience, as a condition of attending the Event, to the fullest extent permitted by applicable law, waives any rights to object to such uses and will not receive any compensation for any use of such photographs and videos.
2. Adherence to Event Rules and Conduct
Audience must comply with all Event rules, policies, and instructions provided by Milbon and its staff to ensure the safe and orderly operation of the Event. Audience must also conduct themselves in a respectful and non-disruptive manner and must not engage in any behavior that interferes with the Event or the experience of others. In the event of any violation of these Terms, applicable Event rules, or staff instructions, or any conduct deemed unsafe, inappropriate, or disruptive, Milbon reserves the right, in its sole discretion, to take necessary and appropriate actions, including issuing warnings, or immediate removal from the venue, without refund, and denial of future entry to the Event or future events.
3. Ticket Purchaser as Authorized Agent
Where a ticket is purchased for multiple individuals, the purchaser shall be deemed to act as an authorized agent on behalf of all such individuals, and shall be responsible for ensuring that each such individual is aware of and agrees to be bound by these Terms. The purchaser represents and warrants that each such attendee has been informed of and has consented to these Terms, including any releases, waivers, and consents set forth herein, and that the purchaser is authorized to provide such consent on their behalf.
4. Liability and Indemnity
Audience understands and agrees that attending the Event involves certain risks, including, but not limited to, personal injury, property damage, illness, or other unforeseen incidents. To the fullest extent permitted by law, Milbon assumes no responsibility for any injuries, accidents, or damages to Audience occurring within the Event venue, except in cases of Milbon's gross negligence or willful misconduct. This includes, without limitation, incidents resulting from slips, trips, falls, collisions with people or objects, falling equipment, crowded conditions, or other movement-related accidents, as well as hair or chemical damage, burns, cuts, allergic reactions, staining, irritation, or other physical or property damage. Audience attends the Event voluntarily, at its own risk, and agrees to indemnify and hold Milbon harmless from any claims or damages arising from their participation in the Event.
5. Waiver of Claims
(1) To the fullest extent permitted by law, Audience irrevocably releases, waives, and discharges Milbon and its officers, employees, volunteers, affiliates, successors, licensees, agents, and assigns from any and all claims, demands, causes of action, damages, liabilities, or expenses of any kind, whether known or unknown, arising out of or relating to the attendance at the Event or authorized use of the Audience's image, performance, likeness, voice, and name. Audience further agrees that they shall not seek or be entitled to injunctive or equitable relief in connection with any such claim.
(2) Audience acknowledges that professional stylists will perform hair services during the Event, which may involve the use of chemical products. Although Audience does not directly receive these services, Audience understands and acknowledges that there is a potential risk of exposure to such chemical products, which may cause adverse reactions or other risks. Audience voluntarily assumes all associated risks. To the fullest extent permitted by law, Audience hereby releases, waives, and discharges Milbon and its affiliates, officers, directors, employees, contractors, stylists, agents, successors, assigns, and representatives from any and all claims, demands, causes of action, damages, or liabilities of any kind arising out of or related to the provision of such services, except to the extent resulting from Milbon’s gross negligence or willful misconduct.
6. No Refund; Non-Transferability
All tickets for the Event are non-refundable and non-transferable, except as may be expressly permitted by Milbon in writing, in its sole discretion. Admission to the Event is conditioned upon acceptance of these Terms. Milbon further reserves the right, in its sole discretion, to deny entry to or remove from the Event any individual at any time for failure to comply with these Terms or applicable event rules, or for any conduct deemed unsafe, inappropriate, or disruptive, without refund or compensation.
7. Confidentiality
Any non-public information relating to Milbon, Milbon’s products, campaigns, business partners, or marketing plans, whether disclosed orally, visually, electronically, or in writing, and whether or not marked or identified as confidential (collectively, “Confidential Information”), shall be kept strictly confidential by Audience. Audience shall not disclose, publish, or disseminate any Confidential Information, including behind-the-scenes content, without the prior written consent of Milbon. Audience shall not disclose any Confidential Information during or after the Event.
8. Governing Law
These Terms, and Audience’s attendance at the Event, shall be governed by and construed in accordance with the laws of the State of New York without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in New York County, New York. Audience hereby irrevocably consents to the personal jurisdiction of such courts and waives any objection based on improper venue or forum non conveniens.
9. Force Majeure
Milbon shall not be liable for any delay, interruption, modification, or cancellation of the Event, in whole or in part, due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, fire, flood, weather conditions, pandemics or public health emergencies, labor disputes, government actions, war, terrorism, civil unrest, or failures of utilities, technology, or transportation. In such circumstances, Milbon reserves the right to modify, reschedule, or cancel the Event.
10. Miscellaneous
These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior and contemporaneous discussions, negotiations, representations, or agreements, whether oral or written. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law. Nothing in these Terms shall be construed to create an employment, partnership, joint venture, or agency relationship between the Audience and Milbon. The Audience is engaged as an independent participant.
